An administrative petition was recently filed in the Tel Aviv District Court, sitting as an administrative court, with allegations against Herzliya Mayor Moshe Fadlon, as well as against the Herzliya municipality, for discrimination in favor of associates in operating a restaurant on Herzliya Beach. The petitioner, Amphi Ltd., has been operating two restaurant complexes on the shores of Herzliya for the past five years, which are located near another business operated by the petitioner, according to close associates of the mayor. No tender, no permit or operating agreement, no business license and no lawful building permit. The petition further claims that although Ampi has appealed to the authorities several times for enforcement, they refrain from exercising the supervisory and enforcement powers available to them, and that this reinforces its concern that foreign considerations underlie the decision not to enforce the business, and the decision to enforce the law against the petitioner. Herzliya Municipality’s response: “Since this is a matter that is pending in court, the Herzliya Municipality is prevented from responding.”
